Terms of Services

Welcome to Bin Kings inc. By using our website, receiving a dumpster or using our rental services, you agree to comply with these Terms of Service. Please read them carefully.

1. ACCEPTANCE OF TERMS 

  • By accessing, using, or paying for any service provided by Bin Kings Inc., the customer acknowledges that they have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding contract between the customer and Bin Kings Inc.
  • Please note: By using our services, the customer authorizes Bin Kings Inc. to charge their credit card on file for any rental fees, disposal costs, overages, fuel surcharges and fees incurred during the rental period. Customer waives the right to dispute such charges if they are in accordance with these terms.

2. SERVICES PROVIDED

The Company agrees to provide the following services upon request from the Customer:

  • Waste Disposal & Hauling: Industrial, construction, and general site waste.
  • Equipment Rental, including but not limited to:
    • Roll-off Bins/Dumpsters 
    • Construction Fencing
    • Portable Toilets & Restrooms (Porta Potties)
    • Additional Site Equipment as requested 
    • Other services as mutually agreed upon in writing.

3. PRICING AND PAYMENT TERMS

a. Pricing

  • Customer agrees to pay the fees/rates set forth in schedule A and on the companies website. Prices may be adjusted based on disposal fees, fuel costs, or regulatory compliance changes. 

b. Payment Terms

  • Full payment is required at the time of service unless the Customer has an approved credit account.
  • All payments must be paid for items after the rental has occurred, waste disposal fees (tipping fees), fuel surcharges, additional daily rentals, and the customer gives the company consent to run the credit card on file for these fees. 
  • Approved credit accounts must pay invoices within 30 days of receipt.
  • Late Fee Penalty: A charge per month will be applied to overdue accounts or declined credit cards past 30 days.

c. Cancellations

  • Cancellations must be made at least 24 hours before the scheduled service to receive a refund.

d. Payment Processing

  • All online payments are processed securely through Stripe. By making a payment, the customer agrees to Stripe’s Terms of Service and Privacy Policy.
  • Bin Kings Inc. does not store or process credit card information directly. All transactions are handled by Stripe to ensure compliance with PCI-DSS security standards.
  • The customer authorizes Bin Kings Inc. and Stripe to charge their provided payment method for agreed-upon fees, including rental charges, disposal fees, and any applicable service fees.

4. WASTE HANDLING REQUIREMENTS

a. Prohibited Waste

  • The Customer acknowledges that local, municipal, city, county, provincial and/or federal laws, regulations, rules and ordinances prohibit the storage of certain items, materials and substances in the Equipment (“Prohibited Items”). Prohibited items include, without limitation, batteries, tree stumps, railroad ties, chemically treated lumber, paints and lacquers, oils, asbestos, infectious waste, contaminated soils and absorbents, inks and resins, industrial drums, food waste, fuels, adhesives, and other toxic and/or hazardous materials and substances. A non-exclusive list of certain Prohibited items is available on the Bin Kings Website for the Customer’s review.
  • The Customer acknowledges and agrees that Customer is solely and exclusively responsible for complying with all applicable laws relating to Prohibiting Substances, and Customer shall be liable for any charges, expenses, damages, losses, fines and/or penalties (including, but not limited to traffic fines and penalties) relating to Customer’s storage and/or transportation of Prohibited Substances in the Equipment.
  • Heavy materials Dirt, Gravel, Sand, Asphalt and Concrete are NOT ALLOWED in the standard dumpsters and only can be put into the 7 yard dumpsters.
  • The customer acknowledges that bins loaded with prohibited items or heavy materials will be required to be unloaded by the customer, before the bin will be picked-up, additional daily rental fees or dry run fees may occur if the bin can’t be picked up on the scheduled pickup day due to these items.

b. Allowable Bin Weights 

  • Bins over 5-Tonnes will be left at the customers location and need to be emptied by customers; incurring the applicable daily rental fee, if the bin is at the property longer than the initial rental period due to the over-weight delay.
  • Our trucks and equipment are heavy. Bin Kings inc. assumes no responsibility for any damages to your driveway or property caused by our trucks or bins during the delivery or retrieval of the rented equipment!

MAX Allowable Weight (Tonnage):

  • 10 Yard Bin – 5 Tonne Limit
  • 15 Yard Bin – 5 Tonne Limit
  • 20 Yard Bin – 5 Tonne Limit
  • 30 Yard Bin – 5 Tonne Limit
  • 40 Yard Bin – 5 Tonne Limit

c. Nonconforming Waste

  • If prohibited items or waste is found in a bin during the dump, the customer will be responsible for any  additional disposal costs and any penalties imposed by disposal facilities.

d. Customer Liability

  • Customer assumes all liability for any property damage resulting from the placement, movement, or removal of equipment. Bin Kings Inc. is not responsible for damage to driveways, lawns, underground utilities, sidewalks, or other property caused by equipment placement or retrieval.

5. EQUIPMENT RENTAL TERMS

The following terms apply to the rental of construction bins, fencing, portable toilets, and other site equipment:

a. Delivery Drop-off & Access

  • The Customer must ensure clear access to the drop-off and pick-up locations. If access is obstructed, a dry run fee will apply.
  • Bin Kings reserves the right to change a bin or equipment rental delivery drop-off date, due to business, operational, scheduling or weather related reasons.
  • See Schedule A or website terms of service for an outline of the fees. 

b. Rental Period & Extension

  • Non dumpster rental equipment is rented on a daily, weekly or monthly basis as agreed in the pricing document.
  • If the Customer wishes to extend the rental period, they must provide written or verbal notice at least 48 hours before the new scheduled pick-up date.

c. Use & Responsibility

  • The Customer may not move, modify, or tamper with rented equipment.
  • If construction fencing, portable restrooms are moved without prior approval, the Customer will be liable for repositioning costs or damages.
  • The Customer assumes full responsibility for damage, vandalism, or theft of rented equipment while in their possession.
  • The Customer is responsible for providing us the proper location for dropping off bins and rental equipment. If a bin or piece of rental equipment needs to be moved after it’s been dropped off a dry-run fee may apply. 
  • Ensure all bin signage and load levels lines are followed. Acknowledging that unleveled loading or loading above the load line may result in a redistribution fee or dry-run fee being applied.

d. Permits 

  • The Customer acknowledges that certain locations and/or uses of the Equipment may require a permit, license, certification or other local, municipal, city, county and/or provincial approval relating to the possession, placement, storage and/or transportation of the Equipment (collectively referred to hereinafter as a “Permit”). Customer represents and warrants to Bin Kings that the Customer (and not Bin Kings) is solely and exclusively responsible for obtaining and maintaining all necessary and required Permits relating to Customer’s possession and use of the Equipment. In the event that Customer fails to obtain and/or maintain all necessary and required Permits, Company may pick-up the Equipment without prior notice to Customer and without any liability to Customer.

e. Weather & Site Conditions

  • The Customer is responsible for securing fencing and other equipment against wind, rain, snow, or other weather conditions.
  • If fencing is knocked down, porta potties are tipped over, or are damaged due to poor site conditions, the Customer will be liable for repair or replacement.

f. Fencing & Portable Toilets

  • Installation and Maintenance, unless otherwise agreed upon in writing. 
  • The Company will deliver and install fencing and portable toilets at the Customer’s designated location.
  • The Customer is responsible for maintaining the cleanliness and condition of the portable toilets during the rental period.
  • The Customer must ensure that fencing remains intact and is not tampered with or relocated without the Company’s consent.
  • Damage and Vandalism
  • The Customer assumes liability for any damage or vandalism to the fencing and portable toilets while on their site.
  • In the event of damage, the Customer agrees to cover repair or replacement costs as assessed by the Company.
  • Access for Servicing
  • The Customer must provide unobstructed access to portable toilets for regular servicing and waste removal.
  • If access is blocked or unsafe, additional fees may apply for rescheduled service visits.

g. Insurance & Liability

  • The Customer bears all risk for damages, theft, or personal injury related to the rented equipment.
  • The Customers renting portable restrooms must ensure proper site placement and maintenance throughout the rental period.
  • Bin Kings has in place both full auto insurance and $5,000,000 Commercial General Liability business insurance. 

h. Return & Pickups

  • The Customer is responsible for ensuring all rented equipment is accessible and ready for pickup upon pick-up.
  • If access is blocked or equipment is not ready (“dry run/unsuccessful trip”) additional rental fees will apply. 
  • Customers must schedule bin and equipment pick-up. The 7-day rental period on bins does not guarantee automatic pick-up on the last day. Any delays in scheduling will result in additional rental fees.
  • Pickups must be arranged at time of ordering or by providing us with 48hrs notice verbally over the phone or in writing. Any pickup requests made after 5pm or on Sundays will be considered being requested as of 8am the next day. 
  • It’s the customers responsibility to provide us with an accurate pickup date.
  • Rentals over the initial rental period will incur a daily rental fee. 
  • Bin Kings reserves the right to change a bin or equipment rental pickup date, due to business, operational, scheduling or weather related reasons. In which the customer will not be charged any additional daily rental fees for the delay. 
  • The Customer has read and agrees to follow important pickup instructions above.

6. INDEMNIFICATION & LIABILITY

a. Customer Indemnification

  • The Customer agrees to defend, indemnify, and hold harmless the Company from any claims, damages, or liabilities resulting from:
    • Improper waste disposal.
    • Damage or injury caused by the use the Company’s equipment.
    • Violations of applicable laws or regulations.

b. Company Indemnification

  • The Company will indemnify the Customer only in cases of gross negligence or willful misconduct.

7. TERMINATION & BREACH

a. Nonpayment & Termination

  • If the Customer fails to pay invoices or violates terms, the Company may terminate services immediately and demand the return of all rented equipment.

b. Governing Laws

  • These Terms of Service are governed by the laws of Alberta, Canada. Any disputes will be resolved in accordance with these laws.

8. SEVERABILITY

  • If any provision of this terms of service, or the application of such provision to any person or in any circumstance, shall be determined to be invalid, illegal, or unenforceable, the remaining provisions of this terms of service, and the application of such provision to any person or in any circumstance other than that to which it is held to be invalid, illegal or unenforceable, shall not be affected thereby.

9. MARKETING AND REVIEWS

  • By submitting a review, testimonial, or other content to Bin Kings Inc., the customer grants Bin Kings Inc. a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, distribute, and publicly display such content for marketing and promotional purposes. Bin Kings Inc. is not obligated to remove any published reviews upon request. 

10. CHANGES TO TERMS

We may update these Terms of Service at any time. Changes will be effective upon posting on this page with the updated effective date.

11. NO WAIVER

  • The failure of any party to insist upon the strict performance of a covenant or obligation hereunder, irrespective of the length of time for which such failures continue, shall not be a waiver of such party’s right to demand strict performance in the future. No consent or waiver, express or implied, to or of any breach of default in the performance of any covenant or obligation hereunder shall constitute a consent or waiver to or of any other breach or default in the performance of the same or of any other obligation hereunder.

12. MISCELLANEOUS TERMS

a. Excuse of Performance

  • Neither party will be liable for delays due to strikes, weather, equipment shortages, regulatory changes, or Acts of God.

b. Liability Disclaimer

  • The Company is not responsible for property damage resulting from bin placement, fencing installation, or porta potty placement.
  • The Customer accepts all risks associated with site conditions and placement decisions.

13. DISPUTE RESOLUTION

Any disputes arising under these Terms of Service shall first be attempted to be resolved through informal negotiations. If unresolved within 30 days, disputes shall be settled exclusively by binding arbitration in Calgary, Alberta, in accordance with the rules of the Canadian Arbitration Association. Customer waives the right to bring class-action lawsuits or jury trials against Bin Kings Inc.
